I am currently unemployed and separated from wife with no assets except for
household things(furniture, tvs, some sporting goods,ect..).I just gave back
an Chevrolet Avalanche I was behind on to GMAC which I will probably owe
6-7K on when all said and done. Plus I have credit card debt of 8-10K on
top of that. Due to an auto accident with the truck there is a Mechanics
lean on the Title for $5400. I am 1 of 8 owners in a vacation property and
am concerned that a lein will be placed on it. Can that happen on the Truck
lein? And if so, would it give them the right to force the property to be
sold or would they only get their money if the owners decided to sell
it. The property has been in our family for 30 yrs and will never actually
be sold I am quite positive. Just didnt want to jeopardize it.
Also, if I use a credit counselor to negotiate the debt down instead of
filing bankruptcy, would creditors have the right to place any liens on
the real estate or future property acquired?
