I am currently in a ch. 13 repayment plan, I have been for about 2
years. Unfortunately my car is near the end of it's life, so I am
going need a new car in the near future. The car payment for this
dying car is included in my ch. 13 plan. Hypothetically speaking, say
I had $5000 laying around that I could use for whatever purpose, could
I use it to payoff the car which has about a $3000 FMV. What would
need to be done in order to do this. The rest of my creditors (other
than the Dept of Education) amount to very little of my debt included
in my repayment plan, so I could pay that off quickly. I should also
mention that I am about to be promoted from a $30k job to a $60k job,
so things will be easier. With all that said, what advice does anyone
have on me getting a new car and possibly voluntarily dismissing my bk
case.

In most cases, it's better to pay off your Chapter 13 instead of dismissing
it. You need to speak with your attorney about how best to proceed--the best
route will depend on the details of your case.
