I got a letter from the trustee asking for a variety of different
information, and he wants it 5 days before the 341. Stuff like the
market evaluation for my house, proof of value of our car, our tax
return etc. Is this the normal course of events? I had been under
the impression that we would bring this information to the hearing.
Our attorney was out of the office all last week, so I haven't been
able to ask her.

Formerly only a handful of trustees would ask for supporting information
to be brought to the 341. Now it is becoming more of a trend for
trustees nationwide to request this type of info. The assumption is
that your attorney should already have it in his (her) file. As far as
timing of the request, that is up to the trustee. Having it in advance
will speed up the 341 process. Anything you do not provide is normally
given after the meeting, ot the meeting may be adjourned.

The crux of the matter is that trustees nationwide are attempting to
insure that only truly no-asset cases are fully discharged as no asset
cases. If there are any nonexempt assets, be forewarned, the trustee
will take them, sell them and ditribute the proceeds to creditors (with
a healthy cut for mimself). The general feeling is that if they clean
up the system, it will encourage Congress to leave the Bankruptcy code
alone.
