View Full Version : Not reaffirming

I filed chptr7 last year and it was discharged in March of this year.
On the advice of my attorney, I let my new car go as a voluntary repo
and purchased a used car before the actual filling. Before the
discharge I was contacted by the finance company asking me to reaffirm
the debt. When I asked my attorney I was told not to, but to continue
making payments. As I recall, he told me that if I ever wanted to
turn the car in I could with not fallout as I had not reaffirmed the
debt and had made all payments.

I'm now moving to Hawaii (poor pitifull me!) and have decided that I
may want to let the finance company have the car back as I'm $2K+
upside down and the cost to send to Hawaii would be another grand.

Can anybody tell me what will happen if I do this and take the grand
I'd have paid to ship it as a downpayment on a used car over in
Hawaii?

Thank You

What will happen is that you drop the car off at the dealer and that's it.
If the debt was discharged, it was discharged, and they can't go after you
for it.
