I would like to learn more about IF and WHEN (not necessarily HOW) to file
for bankruptcy. This would be for an individual not for a company.
I have done some online research, and I seem to be getting lots of
information on HOW. I am interested in decision-making information.
Do you have a web site, or a book, or an article to recommend?
I suppose this can be a complex issue, and it would not be possible to
simply read a comment or an article and form an opinion. However, for the
moment I am merely interested in some "basics." Can you help?
Thanks.

Yes!

Right again!

Yes! I have tried at least to identify most of the
available options as well as various factors
suggesting that certain options might be more helpful
or less helpful in particular types of cases.
Thanks.
You're welcome! Hope the site is helpful to you!
Kindest regards,
Tom

The "if" and "when" are ordinarily very fact-specific, and vary
significantly from case to case. I have written a Bankruptcy FAQ which
should answer many of your basic questions about what is involved--it may be
found at http://users.erols.com/lawyer/FAQ/br_faq.htm.
The best way to find out the "if" and "when" is to speak with a local
bankruptcy attorney. Most offer free initial consultations and he or she
should be able to review your specific situation and let you know what you
can and can't do. If you're in Maryland, DC or Virginia, please let me
know--we may be able to help.
Take care.

The Small Print: This response is for discussion purposes only. It isn't
meant to be legal advice and you shouldn't treat it as such. If you want
legal advice, speak with a local lawyer familiar with your state's laws who
can review *all* of the facts and the law applicable to your situation.
