I just want to be sure of this before I contact a lawyer who
specializes in bankruptcy/consumer matters.
We had our BK 7 discharge on April 29, 2003. We had been making it
clear all along we were giving up the house. Since the discharge,
mortgage lender #1 has been reporting delinquencies on our credit
reports every month, with the amount growing and growing. Now, are
they allowed to do this? I wrote them and sent a copy of the
discharge along with the Schedule F that shows them listed there (as
well as a copyt to the attorneys they are using for foreclosure) and
their only answer was to keep piling these delinquencies up.
Lender #2 has suddenly reported one late payment: we were NEVER late
with any payments to anyone until filing Chapter 7 (we converted from
a 13).
With all the hassles going on right now this is an extra problem we
don't need. I thought BK was supposed to end reporting like this.
The house is in foreclosure but there are potential short sale buyers
and all the paperwork has been signed and will probably go through, if
lenders approvals are obtained.
If we have a case we need to get started on this as this will probably
kill our credit if they keep it up. Thanks for reading.
