Question... Is sears as bad as i hear? I have read a lot about them
showing up for the meeting and just making life really hard. I owe
them a little over 13k (Several items were bought on the card from
sears Fridge, Freezer, Riding mower)and from what i read I am thinking
they are going to be the hardest part to deal with.

I didn't have a bankruptcy but just a missed payment from the anthrax postal
prob's in NJ back in 2001 and they we're the ONLY ONE of all the credit or
mortgage companies that insisted that they leave the 30 day late on my
credit!!!
So if I we're you I would be prepared for the worst, I will NEVER get
another credit card from them and will probably NEVER shop in their stores
again!!

They may be like a furniture store and have recourse against the major
ticket items you purchased. I know a furniture store can repo it's
stuff. Probably can with a freefer and a riding mower too.
Also, if you purchased any of those within the last 90 days, that I
understand is real bad too.

Sears may have a security interest in these items. Discuss with
your attorney how best to address it, and whether you will need
to sign a reaffirmation agreement.

Sears may try to push you into paying for the fridge, freezer, and
mower. If you cannot reach a settlement with them, you might have to
return these items. You really need an attorney to guide you through
the BK process.

At my 341 in March of this year Sears had a representative there to sit
in on the meetings. Me and everyone else who was there was a little
nervous because we just didnt know what their intentions were. I had
listed Sears on my Ch. 7 at $3800.00, most of which were little items
mostly clothng and auto related items. The largest items bought from
them was a portable air conditioner and puch lawnmower (3 years ago). My
attoreny of course knew all the facts for my case so he felt they
wouldnt even be involved in my case. Well I was in the wating room 1/2
hour before my case and seen this lady sit in on 3 cases, which made me
a little nervous. My time came and she didnt attend my hearing.
Afterwards my attorney basically said, if i would of purchased an items
within the past year (tractor, Large TV, appliances) they would of been
in the hearing. They are going after people who purchased items that are
of some value even though they dont have an immediate interest in the
resale.
I know Sears has a warehouse outside of Pittsburgh where they sale items
taken from bankruptcy's, it is quite large and they often have a flyer
in the the local newspapers for a clearance sales. Most of the items
could be had at a good price, so in the case of Sears whosing up I would
bet they will but it all depends on what you bought and if it is any
value to them.
