I live in texas and had a $5K judgement against me for a car that was
repoed in 1984. Long story short, I lost my job and couldn't pay it
off so there was a judgement.
The judgement was sold 6-7 times to various places over the years. It
also has grown from $5K to about $22K now (bs attorney fees, interest,
etc. - yeah, right).
I was on my credit for 7 or 9 years but, credit is perfect now.
Anyway, this last creep that bought it found me about 1 year ago. He
tried to dipose me to meet with his attorney to explain all my assets
but, thankfuly, I spoke to an attorney first and he said to not show
up (I wasn't served paper).
Since I couldn't make it there, he showed up at my home and I
explained there were no assets that weren't exempt (no swiss chalet,
no property in vail. LOL!)
I tried settling with this guy for a fair price (afterall, he bought
it for probably 3 cents) but, it was a no go.
He then contacted me 3 months later with a lower amount but, my
situation had changed so I offered a lower amount. Again, he passed.
This process was repeated 2-3 more times.
About 1 month ago, he got the idea to demand the mortgage company
where my loan is to give them any corrspondence, copy of checks, loan
papers, etc. He also did the same with a car company since when he
came to my home, he saw what type of car I had.
I had an attorney try to quash his request but, the judge sided with
this creep.
I don't have the $22K, I don't have $5K, I am not going to pay this
yahoo monthly. My car has a reverse equity, I have no savings
account/money market/stocks. Since I work for myself, I don't even
have health insurance or a life policy. The only thing of value is my
home and it is homesteaded and exempt.
So, my question is, at what point will this judgement end? We are
coming up on the 20 year mark in 2004.
Can he keep renewing it and keep hassling me forever? What can I do to
get this guy off my back?

Judgements go away when
(1) you declare bankrupcty
(2) you pay your creditors
(3) the status of limitation for your judgement expires. It varies in each state.

I found out that the status of limiation in Taxas for a judgement is 10 years.

In your case, it is almost 20 years. Did your attorney tell you that?

Yes, but judgments can be renewed indefinitely.

Kim,
You are partially correct. It is indeed 10 years in TExas BUT (and
this is the BUTT part) you can renew it for another 10, and then
another 10,....
I have no assets with any equity in it but, this guy refuses to go
away or settle.
I don't want to have to file bankrupcy for just this one thing (we are
eeecking along right now).
Is there any other options available to me?

I know there are limitations as to what a collection agency can do to
a person.
And there are limits as to what they can do if you file bancruptcy.
Are there no limits with a judgement?
At what point does this constitute harassment on this guys part?
Is there anything I can file (short of bancruptcy) to just make this
guy go away for good?
I don't have the 22-24K that he claims the judgement is now up to. I
can't create a monthly payment plan with him for that amount as that
extra payment will force me to file for bancruptcy (we are right on
the end of hacing to file for it)
I am 47 and have been out of work for 2 years now.
The only thing of value I have is my home and I'm not selling it to
pay this moron off (it's also homesteaded and exempt)
Short of hiring a hit man, what can I do?

If he has a valid judgment, there isn't much you can do other
than do nothing, pay it or file for bankruptcy.
