View Full Version : Beware of Repairing Your Credit Report!

OK, here's what happened. Three years ago I had a car repossessed. I had
lost my job and couldn't make payments. About a year ago I contacted an
attorney about filing bankruptcy and have muddled on without filing this
last year. I have struggled and done without to catch my mortgage up after I
nearly lost my home, bought a cheap car from a relative that I still owe but
am making low payments on, etc. After I started working, I decided to repair
my credit as best I could and sent dispute letters to Equifax about
everything. It worked pretty well because many of the owed amounts were old
and they dropped off my report like dead flies. I have recently gotten
everything caught up and firm in my job (as one can be:).

Now THIS is what happened with the car. I have been chased by lawyers (I
declined to accept a certified letter) and am being stalked by a process
server that showed up at my workplace. I told the folks downstairs that I
did not know her and they sent her away so I still haven't been served. I
was told by one person that they can stop me for a minor traffic violation
and will have a bench warrant for my arrest for ignoring it! I can't sleep,
my ulcers, chest pain, are kicking up and the only thing I can point to as
to why they are doing this is that I sent a letter to Equifax. I did and do
deny that I owe as much as they want me to pay. This car was 7 years old,
they sold it, and now maintain that I owe them $5000 MORE than what the
sticker price was on it new! Never mind that I paid on it for almost 4 years
when they repo'd it! Be very careful of trying to clear up your credit
report. Mine backfired on me big time! Just when I thought everything would
be OK! Well, anyway, going to try and file bankruptcy if I don't fall over
with another heart attack. If I lose my job over this can they take my home,
send me to jail? I have a daughter to raise and an appointment with an
attorney Monday but I'm a nervous wreck:(

Absolutely untrue. Failure to pay a deficiency after a
repossession is not a criminal offense, and will have no impact
on your driving privileges. Yet another example of a collection
agency lying.

Relax over the weekend; the attorney will be able to help.

Thanks Brett, I haven't slept in 2 days over this and I can't eat...nerves!
I will be glad to get this over with! I tried to use Consumer Credit
Counseling but I didn't last more than 3 months making the payment, just
didn't have enough money. I have really tried over the last 3 years to get
myself upright but it seems like I get knocked down every time I get up!
