Ok, so, the last 10 years, after starting a new business, I finally
got myself up to about $70,000 in credit card debt. The final straw
was when one of the card companies raised my interest rate from about
19 to 23 %. i finally realized, i was getting nowhere, and those
bloodsuckers had made, in the last 5 years, over $70,000 in interest
on my accounts.
So, now i am looking into these "credit card" debt elimination
programs, advertised pretty strongly all over the web. Naturally, i
am not suckered into the spam emails, but am looking for a reasonable
and established company to help me get this debt eliminated.
restructuring is not possible. lowering the interest level is
interesting, and yet, because of a downturn in my business, i am still
pretty much unable to service the debt ($1500 to $2000 / month).
I do not care if my credit is ruined for 5-7 years. i do not plan on
buying any major ticket items, and as for cars, i can always buy used
at about $3 to 5k at local dealer auctions.
i figure if i start saving - in cash - the $1500 a month i have been
paying, in about 6 months i will have some decent cash to start make
some settlement offers. i am hoping to settle for between 25% and 35%
of my debt.
anyone with experience on the debt elimination / settlement
programs???
thanks everyone.

Ain't gonna happen. You assume that the cc companies act as you
would. They don't. 50% is generally a *great* deal, and you
usually have a chance of getting it if you're account is at least
90 days past due.

Bob,
Don't go there. Most "debt elimination" firms are scams who charge
exorbitant fees to do for you what you could do yourself without paying
thousands in "administrative fees" to these scamsters.
Whether you attempt to negotiate settlements with your creditors yourself,
or you use these "debt elimination" firms, you'll ruin your credit, and your
credit will STAY ruined for seven or more years. Also, note that you'll
never get a 25-35% settlement from creditors. You'll be lucky if they
settle for half the amount you owe, plus penalties, usurious default
interest rates, and fees. (The reality is that you'll probably be made to
settle on 70-75% of the original amount owed before default.)
Your single best option to eliminate your debt permanently? Assuming you
don't have much equity in a home, or any expensive automobiles, that would
be Chapter 7 Bankruptcy. Liquidation. Full discharge of unsecured (i.e.,
CC) debts.
Trust me, you'll thank yourself once you've done it.

Good lucks. While you wait and default for a settlement, your CC
interests, late penalties, and over the limits penalties (if
applicable) will continue to pile up. They are not going to stop.
Your outstanding debts are not going to stay the same during this
time. Your debt will go up quite a bit.
Your monthly saving of $2000 can barely cover the interests (23%) of
your total debt ($70,000) during that time. That amount of the
monthly saving is not going to get you anywhere.

Oh sure, they promise to work with your creditors, but "forget" to tell you
that (while you are making payments to them) some of the creditors
(Citibank, for one) refuse to work with them.
So while you are thinking you are finally making progress, Citibank reports
you months late, destroying your credit report and hounds you into
bankruptcy while you wonder what happened to the money that all this
time.....
Ask me how I know.
Oh yea, and I worked with Ameridebt, Neway, and Money Management
International.
And they all promised the sky and just delayed my realization that Chapter 7
was the only way to go, if I knew then what I know now, I'd have saved a few
bucks and filed early so I could start my road to recovery that much
quicker.
Of course this is just my story.

My Father is going through the cc eliminations method right now and 4.5
months in has had almost all the companies try to settle the debt for 35-50%
of the original balance. I also know another aquainitence that is about 8
months along in the process and she has had around 34,000 dollars total,
eliminated from several ccards with only 1 more card to go that has 6000
dollars on it or so. There are companies that you do have to watch out for
but the process I have seen personally seems to be working.

Ok, thanks for the input. I was mainly desiring to know if any of the
debt elimination companies really worked. When doing a google search,
there are lots of them "advertising" - and yet, finding feedback is
pretty difficult. That is the reason for my post here. There seems
to be a resounding "no they do not work they are only after your
money" reply.
I was also interested to know the effect of filing bankruptcy would
have on these debts. Obviously, chapter 7 as i think it is called
would leave the least recourse to the credit card companies. the
complication is that i own my own business - actually a corporation -
but here in texas it seems as if the personal exemption in assets is
$60,000 for a married couple. I should be well within that limit.
At this point, even thouogh my credit is quite good (mid 600's), i am
so tired of paying on the cards that I am willing to go through a
bankruptcy in order to have the credit card debt eliminated - or
reduced to a manageable level.
Like i stated previously, i have no need to purchase any big stuff on
credit in the next 5-7 years. however, i do realize that a bad credit
affects everything - including even buying a cell phone and your
insurance rates.
one thing that i do know (at least i think i know), which i have not
seen addressed in this forum, is that the reason everybody will extend
you credit once you have emerged from bankruptcy, is that you can't
file again for at least 7 years. therefore, if you default on a loan,
they and sue and sieze assets with little effort.
i guess one of my lines of thinking is that, with the interest rates
like they are on my cards, it would take me 10+ years to pay off the
current debt. if i just decide to hell with my credit, i could be out
of it in just the length of bankruptcy. then i just have to wait out
the bad credit time, which seems to be just a few short years as
stated in some other posts in this forum.

I had a friend who was $25,000 in the hole and was working a minimum
wage job. He enrolled in one of those and -- guess what? -- two CC
companies refused to work with the debt consolidator. He sunk a good
percentage of his income in that scam and then went bankrupt.

Please be advised that if only one entry on your credit report shows or
refers to a BK., I as a Mortgage Banker will ask for a full set of papers
with schedules and ask which chapter you were/are in.
If it does not sound good, we may ask you to prove that you had not filed
BK. or do our own search.
Guess what if we find out that you in fact had filed, NO LOAN and possibly
prosecuted for falsifying your loan application.
So, from a mortgage point of view, be honest up front. If your loan
officer helps you falsify the application and it is found out, the two of
you will be sharing facilities.
Just to let you know.
Thanks,
SS

Provided you filed for bankruptcy, it cannot legally be removed
from your credit report. Anyone claiming that they can do this is
either a scam or will involve you in illegal activities.

I've read the FAQ on their website. They're charging $1000-1500 to do the
very same thing that my wife and I have been doing ON OUR OWN for, hmm,
let's see... $38.85 per set of three credit reports, times two (one set for
each of us), times three (every two months for the last six months)... plus
let's say sixty cents in postage per dispute letter, and we've sent a total
of eighteen of those (six letters each time we get our credit reports and
find errors that need to be disputed and corrected...)
That's $244 spent to do EXACTLY what these scam-artists are CLAIMING to
do... and we've done it THREE times for that $244. Looks to me like they'll
send dispute letters once for that $1000.
Well, it's your money. If you want to throw it away enriching scammers, be
my guest. As far as I'm concerned, however, it makes a hell of a lot more
sense to take control of your credit rating YOURSELF and do all the legwork
YOURSELF instead of paying someone to do it for you. Cripes, it takes only
an afternoon to read your credit reports and prepare dispute letters for the
CRAs and individual creditors (which is sometimes necessary if the creditor
persists in reporting incorrect information and must be dealt with
individually). It's not rocket science, and it's CERTAINLY not worth
throwing away $1500 when you can do it yourself, and more effectively, for
$1250 less.

Oh, and when I send my dispute letters, I'm only disputing incorrect
tradelines, not disputing all derogatory tradelines. That's the other
difference. I can sleep peacefully at night with a clear conscience knowing
I'm not lying to the CRAs or attempting something ethically questionable.

Yes, most of those websites are trying to be as ambiguous as possible.
They do not want to be specific. For example, BK on my credit report
can only be removed, if the entry is wrong (in other words, if I never
filed BK), or if the entry is long enough to be dropped off (for Chap
7, at least 10 years and for Chap 13, at least 7 years)
They are trying to give people a false impression that BK can be
removed under any circumstances. It is a warning sign to stay way
from this one.
"Brett Weiss" <lawyer@erols.com> wrote in message news:<rYidnUst8o_mu_6iXTWJkg@comcast.com>... Provided you filed for bankruptcy, it cannot legally be removed from your credit report. I have no experience with the "Take back your Credit" company. I believe it
is separate from the cc elimination company. I looked at the FAQ page you
referenced and as the others have said, you can't take a bankruptcy off your
credit report but I believe they are saying they will take off as much
derogatory remarks as possible. As far as the cc elimination company I
have seen them help people first hand and know that it isn't a scam. That
is why I responded to the original post by Bob when he asked for anyone with
experience with this type of program.

the website referred to by brett way above, www.drg.cc
interestingly contains no indication of any address.
That makes is smell very scammy...
This is why i posted here on google, I figured with the scores
of ads for debt elimination, there had to be some people with
experience. the traditional way - via lawyers / bankruptcy,
is looking better and better.

Yes, you notice that, huh, too.
On that website, they also claim that if the customers are not
satisfied, they will refund the money. I want to know how the
customers are going to get their money back if the customers do not
even know the actual address.
