I'm new here and have made a few posts for advice and I haven't got any real good advice yet. We are prepared to file Chapter 13. With payments of 2200 over about 56 months. That includes our cars. We thought it was really stupid that they would only allow us $75 per week for food! We spend frugally now and it costs us about $125 a week for food. We decided that was no way to live, we just can't do that. What if hypothetically I quit my job because of pregnancy losing about 1200 per month leaving only about 1000 per month extra. Would we still have to file Chapter 13 or could we go with 7 considering we have another mouth to feed on the way and would need to move to a bigger apartment. I understand what is left after expenses combined with what percentage you would be paying back the creditors determined whether you file 7 or 13 am I correct?

It's impossible for me to answer your questions without a
detailed review of your fiancials, knowing which exemptions are
available to you, etc. Around here, food expenses are usually
$150/month/person, so I don't know why only $75 was alotted. I'd
sit down with your attorney and see why he/she set things up as
you indicated.

That turns out to be the same amount. $75 a week for two people is 300 a
month.
Your estimate was 150 per person equaling 300 per month.
As I stated in my other post we feel we should not file any bankruptcy at
all and make payment plans with the collection/creditors individually that
will still allow us a somewhat comfortable life. We know we will have to
let some just go and deal with the biggest ones first. Either way our
credit report right now is bad showing only 9 current accounts out of 19.
Nine we are able to never be late and keep up with. Others are in
collection already and some are 120 + delinquent. Most of the debt was
incurred by my husband before we married. We are 30 and 33 and really want
to start having kids but its hard when you don't know how youre going to
live and pay all the bills too. The hard reality is we don't qualify for 7
right now and really can't afford the restraints of a 13. We have to let
some slide. Do they really come off our credit report 7 years after last
date of activity? Assuming its called bad debt, charge off etc....?
