We were told by an employee in our lawyer's office that we were not to
include our monthly credit card debt when adding up our monthly
expenses. Is this correct? Thanks.

Yep. Unless you have made arrangements to reaffirm.

Yes, it is correct. Since this debt will be discharged, it won't
affect your budget.

This may cause problems. I recommend discussing it with your
attorney.

news:3F1B56F4.7000408@home.com... Let's say you have a credit card through a bank that also holds
the title/loan on your vehicle. I plan to reaffirm the vehicle,
however, the car is cross-collaterallized with the Visa from that bank.
So, I will have to pay it/reaffirm that card. Can I include the
minimum payment for that Visa as a monthly expense since it is tied to
my vehicle? Brett Weiss wrote: Yes, it is correct. Since this debt will be discharged, it

If you had a client in this situation, would you just recommend
continuing payments and then officially reaffirming after the 341? I
have to reaffirm the vehicle with this bank anyway, would signing a
reaffirmation for the card that is tied to the vehicle pose a problem?
I don't have a problem not listing this as a monthly expense. It's only
a minimum of $40 a month. Besides, my mother actually pays this bill
for me. Is there any reason to inform the trustee of that?

It's impossible to say without a detailed review of your
situation and case.
