View Full Version : Parents bankruptcy and me

Greetings.

I have some questions regarding bankruptcy.

My parents are needing to file bankruptcy. They have defaulted on their cc.
They are on a limited fixed income and are living in a shack with no power,
running water, telephone or indoor facilities. It is a sad thing. They both
have been in the hospital with heart problems (bills from that) and my
mother needs a heart valve replacement. They live in TN.

I live in GA. I am a FL resident (husband in military) but way back when my
parents put me on their cards. I now am having collectors send me letters
(at their address) and my credit has been affected.

When they file will the debt be discharged for me or do I also need to file?

If I don't file can I get those hits off of my credit?

If I do file where would I do it at and will my families assets be affected?

Thanks in advance for all of the assistance. I am trying to find information
for them and also myself.

Thanks in advance for all of your replies.

Their Chapter 7 would not affect your obligation for your debts.
If I don't file can I get those hits off of my credit?

Not unless you pay them.
If I do file where would I do it at and will my families assets be affected?

You file in the state where you live, work, or have the majority
of your assets.

I have written a Bankruptcy FAQ which should answer many of your
questions about what is involved--it may be found at
http://users.erols.com/lawyer/FAQ/br_faq.htm.

I strongly recommend speaking with a local bankruptcy attorney.
Most offer free initial consultations and he or she should be able
to review your specific situation and let you know what you can
and can't do.

Take care.

My ex-husband had me on a couple of cards of his, and I tried to get the
accounts closed during the divorce proceedings, but I was left powerless to
do so. He decided to run up large balances and not pay them on purpose. He
then filed for bankruptcy, and I started getting calls, letters, even
getting harassing calls at work. I had no choice but to file, and I feel
that I've really ruined my life by doing so, since I've always been the type
to pay my bills.

If you can't pay the debts, you probably won't have any choice but to file
yourself. I'd talk to an attorney about it.
