A year ago my wife and I decided to file Chapt. 7. We retaied a lawyer
and are continuing to mkae payments to him and have not proceeded
furter. In that time my wife and I have separated. (not legally
separated yet) With my income and expenses by myself I feel that I
have enough to begin to payback the debts on my own, assuming payments
were not too high. My qustion is, should I continue to pay the lawyer
and probably have to do a chapt. 13 or stop paying lawyer and call the
creditors on my own to work out a payment plan with each of them. They
have been more than willing to work with me since knowing I was
filing. I would think they would be happy to get anything at this
point. I would appreciate any suggestions.

Thanks

I would stop paying the lawyer. Your situation has changed. Research
all your options first; you may be able to negotiate with your
creditors for pennies on the dollar and avoid BK altogether.

If you decide to go with a Ch. 13 later, you could always resume
payments to the lawyer at that time. No sense paying for something
you're not sure you need.

"pennies" on the dollar?? That is not realistic. 50% to 75% is closer to
a negotiable agreement!
