Hello all.
(I feel like I am in AA for some reason.)
My name is Daniel and I am in serious debt.
Capital One just sent me a summons, and I had
been considering filing bankruptcy before that.

I really can't afford a lawyer, and I need to
file in 20 days, otherwise I will be sued or
something. (Seeing as I have no money, I don't
know what they could get from me.)

I have two questions.

1. Is there anywhere I can find a step-by-step guide
to filling out these forms I have downloaded?

2. I am in school and want to stay there. (In fact, I
am about to apply for graduate school).

Please help me people...

Bankruptcy cannot be taken into account when applying for Student
aid, but conversely, Student aid cannot be discharged through a
bankruptcy.
I don't know about student aid ONCE YOU RECIEVE IT-- talk to an
attorney, and for heavens sakes, don't leave it in a bank account that
can be frozen.
On the other hand, I've always been confused about that-- I know
some student loan officers who have stated that they can't take it
regardless-- it isn't your money, it's the governments money, given to
you for a specific purpose, which doesn't include paying the bank.
OTH, none of those advisors were attorneys, and if your a college
student, you know just how common... misunderstandings are in such
meetings.

Are your debts student loans or credit card debts? I assume that they
are credit card debts. Students loans are not collected while you are
still in college.

Most college campus do have legal aid offices. Check your campus.

Bankruptcy cannot be taken into account when applying for Studentaid, but conversely, Student aid cannot be discharged through abankruptcy.

It sure as hell can for PLUS loans!

No loan if there has been a BK in the last 5 years.

You may want to consult a legitimate Credit Counseling Bureau which can
consolidate your credit card debts into an affordable monthly payment,
and get the collection agents off your back. Your local Better
Business Bureau should be able to help you idenify a reputable firm.

First off, I would not file bankruptcy pro se (by yourself). It's very difficult and you can easily mess up the forms.

Having said that, a Chapter 7 will cost $200 in filing fees and a Chapter 13 will cost $180. Since I'm assuming you have no income at this point, you probably want to go Chapter 7 and reaffirm on any debt you want to keep (a car, for instance).

If your campus does not have a legal aid office, you may want to check in town for one. They may be able to help.

God do I love these CC companies! An applicant has no income and yet they hand out debt like a drug dealer hands out crack. "Get 'em young and get 'em hooked" must be their marketing motto!

The $200/$185 are the fees charged by the Bankruptcy Court for filing. They are not the attorney's fees, which are additional.

If you have no income, they can't garnish it. If they can't garnish your
wages, they can't get Jack Squat from you. The worst they can do is secure
a judgment against you that you can either (a) discharge in bankruptcy at a
later date, (b) settle when you can afford it, or (c) ignore and hope they
don't pursue it aggressively.

Don't even THINK of going the pro se route. It's NOT worth it for the
meager savings over going with an experienced attorney who specializes in
bankruptcy law. Trust me on this. (And no, I'm not a lawyer, I'm someone
who's gone through BK7 and knows whence he speaks.) Don't have a job? Get
one. Even a crappy one. You DO realize that even were you to file pro se,
you'd still have to pony up the filing fees, and honestly, hiring an
attorney isn't terribly expensive -- my wife and I filed jointly, and our
attorney's fee was a flat $600, the filing fees $200 more. Are you saying
you can't come up with even THAT amount?

You can't be denied Stafford and Perkins loans because of bankruptcy. Thus,
you have nothing to worry about unless you're seeking PLUS loans, which ARE
dependent on a reasonably clean credit record.
