View Full Version : Access to Public Highway from Property (Alabama)

I own a small parcel of land in Shelby County. The land does not border a highway. A small parcel, owned by another party, lies between my property and the public highway (Hwy 61).

Is the owner of the land that is between my property and the public highway required to give me right of way for a driveway to my property and public utilities such as electricity, water etc?

If your land is surrounded, you are entitled to an easement by necessity. You need to find out where you go to get the filed within your county.

Your response and information is very much appreciated. Any ideas as to the best office to approach with this question? I have contacted the Probate Judge's office but they don't get involved with these type matters between individual property owners. :)
