I OWN A COUPLE OF ACRES IN AN AGRICULTURAL AREA IN KENTUCKY.I AM PRESENTLY CONSTRUCTING A BARN AND PLAN TO KEEP A COUPLE OF HORSES THERE. SOMEONE HAS JUST PURCHASED THE LAND ADJACENT TO MINE AND HAS STARTED TO BUILD A FENCE ON THE PROPERTY LINE. THE NEW PURCHASER OF THIS PROPERTY I BELIEVE IS OUT OF STATE AND I DO NOT KNOW WHO HE /SHE IS ,OR HOW TO CONTACT THEM.
MY CONCERN IS THAT THE PERSON MAY CONSTRUCT A BARBED WIRE FENCE OR A FENCE THAT WOULD DETRACT FROM THE VALUE OF MY PROPERTY. I HAD ALSO PLANNED TO BUILD A FENCE ON THE LINE (WITH AGREEMENT OF THE CURRENT OWNERS OF THE ADJACENT PROPERTY) BUT I HAD PLANNED A WOVEN WIRE FENCE WITH A SINGLE STRAND ELECTRIC WIRE AT TOP.WHAT IS MY LEGAL POSITION IN THIS SITUATION ?

Go to your county tax office - they will have records of the owners and an address where they can be contacted.

If they build a fence within their own lot lines there is not much you can do about it unless it creates some sort of nuisance. (Interference in the enjoyment of your own property.)

I suggest you try and reach them and come to some sort of mutual agreement regarding the fence. I am not a horse person - would barbed wire present a problem? If it does you may want to pass that along to your neighbors.
