Hello,
I have decided to accept a teaching position at another university and will be giving the "at least one full term (semester)" notice, to my present employer. My question is that if the term (semester) in my current postion ends on August 24th and my new position starts on August 21st, can my current employer take legal action against me for starting work at the other university 3 days prior to my said resignation date?

I have a contract from the current employer and have signed an official offer from the HR department of the future employer.

Then the contract will prevail. If there is no prohibition against this in the contract, I would guess it wouldn't be a problem, but I would have an attorney review it just in case. I'm just making an educated guess, not having read the contract in its entirety.

I did not see anything about any prohibitions.....only a short bolded statement of "at least one term (semester) of notice, or punitive damages will be sought". Since in the current position my classes are at night and those last 3 days are devoted to finals and the new position involves daytime classes, and the first week in the new position will be devoted to introduction I do not see any time conflicts. I just want to be able to know the difference between real versus empty threats for peace of mind.
