My neighbor behind our house built a fence between our property lines four years ago. I helped him build part of it. Three years ago he allowed me to tie into the fence with my fence on the sides of my property.

We recently had a disagreement over a shed he built too close the property line and the homeowners association made him remove it.

He now claims the fence between our property line is 6" on his side of the line and is demanding I remove the tie in to his fence. I will have a survey done to confirm this.

Do I have to remove the tie in since he gave permisson once and the tie is has been there for three years? Is a fence on the property line common property? Is 6" off the the line still considered on the line?

Permission can be revoked at any time. Over the line is over the line.

If you have permission in writing, then I suggest you take it to an attorney and seek damages for any removal and changes that are to be made. IT is up to you if you want to pursue, but it is not like you put it there without his ratification, so consult an atttorney.
