How much notice are you required to give in regards to COBRA? By that I mean, we have an employee who has not paid his portion of the premiums for 2 months. We have a new health plan effective this month, and do not want to continue to cover him. He is being sent a termination of employment letter, as he has not responded to any of our companys letters/ phone calls in regards to his job or his insurance. He is an outside sales person located in a different state, and there are no direct wages to attach to since he has not sold anything, thus why he hasn't paid any premiums. Can we drop his insurance effective May 1, 2006? Or since it is now 5/3, do we have to make it effective 6/1?

If his termination is effective 5/3 you are much, much safer in making it 6/1. I assume from what you are saying that your policy terminates on the last day of the month only and that making the termination of insurance effective 5/3 is not an option?

That is correct. I re-read the administrative guide last night for our new plan, and it says that we are basically required to give him until June 1st. I appreciate your response. Thank you.....
