14 mos ago I answered an ad to rent a condo. The unit was in escrow and the new owner resided out of town with no intentions in living in the residence. We met, liked each other and decided this would be mutually benefical for all. The owner was not informed that the condominum association absolutley forbids renters..period. Which left him in a real bind. He stood to loose some of his investment because he COULD NOT move into the condo. The only legal way to get the homeowners assoc. off his back and enable him to keep the property was to give me 1% ownership and added me to the title/deed. We had it notorized and sent it to the assoc....That sent them on an ongoing 1 yr long tangent. I've been fined twice for parking behind my garage, once while moving in.but, that's not the problem
I have just lost my job due to company dissolving and unable to collect unemployment as the agency had classified me as an independant contractor.
What started out as a 'great' relationship has turned out to be a nightmare. I completely understand the predicament this has on the new owner and never intentionally did anything to jeopardize the arrangement. I am 1 month behind owing for April.
He has now been threatening, harassing me and showing up and letting himself in without any notice. He says he wants me out in 1 wk but I can leave all my belonging here until I can move them. I do not have anywhere to go (that's the honest truth) I am frantically doing what I can and have kept in contact with him but he is mean and relentless and a very young 24 year old correctional officer.
He has lynched the homeowner assoc hounds on me who just showed up by not knocking on my front door but coming through my back gate up to my back kitchen door :mad: Now they are telling me I can not use a generator at ANY time yet my next door neighbor had been using one for over 2mo during renovation??? I wonder if their rules apply to everyone ...or just me? :mad:
Here are my questions:
1. What legal rights to I have as 1% owner
2. what methods does he need to take to get me out? I have no intention of squatting and truthfully will be relieved to get out of here and away from this homeowners association from hell.
3. How much time do I have.
4. Am I entitled to any equity or proceeds from the sale of the condo. He purchased it a little over a year ago for 229,000, Please respond asap as he won't be knocking on my door ...he'll simply let himself in.
