I want to know if a company has to pay you for drive time in a company van. We are told the 1st hour of drive time to and from work is counted as our time. Anything over 1 hour is paid by the company. Is this legal? Isn't the company responsible for me from the time i enter vehicle until the time I get out of vehicle?

No, not from your home to your first job site of the day, even if that is the office, and from the last job site of the day (or the office) to your home. That is commute time and is not compensable. The fact that you commute in a company vehicle is not a factor.

Ok how about this then. After 1st job of day we get paid for drive time to each job we go to during the day. We work several jobs a day. Our billing consists of drive time and labor. So you think we still shouldn't get paid for driving to 1st job and drive home from last job even if its 2 to 3 hours away from home. That means we could put in a 14 hour day and get paid for only 8 if we had a 3 hour drive to and from work.

Well, if you want to call the DOL and ask them that, you're free to do so. But the regulation seems pretty clear. (866)4-USADOL.
