I do not understand the overtime laws on salary employees. Could someone break it down for me. I am salaried for 80 hours bi-weekly payroll periods. Another question: If I was a registerd nurse would my employer have to pay me on call time?
For just staying home whether I made an actually visit or not? :confused:

"Salaried" is merely a pay method. We need more details about your job in order to answer.

I am administrative assist/computer coordinator my salary is figured at 12.00 an hour for a 80 hour pay period. I usually work at least 50 hours each week, but since I am salary I am not paid overtime have Flex time/comp time that I am suppose to use to compensate for the overtime, but you had stated before that only gov/state qualify for comp time correct? So were does that leave my overtime? Is the company breaking Arkansas labor law? The company I work for is a home care provider based in Alabama(corp office)all patient care offices in Arkansas, it is a private for profit company. We also employ nurses which work overtime and on call hours for flex/comp time, they are employed for 45,000/50,000. a year salary.

Based on what you've told us, I doubt you would qualify as an exempt employee.

Having said that, you are understanding comp time correctly. And overtime hours cannot be "rolled over" into the the workweek in order to avoid paying overtime. The pay frequency is irrelevant; each workweek stands alone.

It does appear there is a violation of the FLSA, to which all states must adhere. You would file your claim for unpaid overtime, however, with the state Dept. of Labor.
