My ex-girlfriend and I purchased a home in 2002 in FL. My name only is on the mortgage, however both our names are on the title. I have exclusively made all payments on the home since day one (downpayment, mortgage payments, home improvements, taxes, insurance, you name it). We have since split up and the house has apprecitated significantly, is she entitled to half of the profit?

WHY did you put her name on the title without it being on the mortgage? She now has part ownership in the house, but has no obligation to make the payment. Your best bet may be giving her a small payment in exchange for a quit claim. Talk to an attorney!

Probably yes. Consult an attorney. The thing is-- you put her on title, so does it matter that you paid everything because if you were trying to simulate marriage, she probably did something around the house. You may be able to settle with her in exchange for a quitclaim deed of her share of the house. You may want to approach her making it sound like you need to get some things fixed with the house and since you are taking care of everything and she does not live there anymore, would she be willing to quitclaim her share of the house back to you. She may be willing to do it for nothing. If she is willing, maybe you two can meet at an attorney's office or you can get a quitclaim deed drafted and meet her at a notary office for her to sign.

By putting your girlfriends name on title you a created a presumption that she is entitled to half the value. Let's hope your girlfriend does not see an attorney.
