View Full Version : Can You Be forced to be at work with no pay?

I am a Auto mechanic in colorado. I work on commission. My boss says we have to stay until the end of the day, even when we are out of work. If there are no cars to work on I am not making any money. Can he really force me to stay?

Yes. The employer is within his legal right to set your schedule, whether there is work or not. That time must be considered hours worked, however, and must be taken into consideration when determining whether your average hourly rate is at least minimum wage and/or you worked over 40 hours in the workweek.

so since we are not exempt from the wage order in colorado, but only exempt from the overtime portion can they require us to work more than 40 hours in a week? i too am a auto tech in co and i am required to work every 3rd saturday with no "comp" day off in the week proior or following.
