I started working for a world wide tree company that gets paid every week. I was told by a supervisor that the first week would be held back as far as getting a paycheck. I am starting my third week without any paycheck. When I bring this up to my immediate supervisors, they simply say,"You are only a couple of days late on recieving your check..." The checks are mailed from Pa., and are sent to the crew's foreman's homes, and are distributed out on mondays or tuesdays, payday is supossed to fall on fridays, but unless you have direct deposit, you are at the mercy of the foreman. My forman quit the company and I have yet to recieve a check. I had to pay for a D.O.T medical card to drive their trucks. No one issues any protective equipment such as gloves. I need to know if this would hold any ground in court. Please, I need some guidance...

Unfortunately, Florida does not have any provisions in the law that require you be paid on a certain frequency and/or within XX number of days following the end of the pay period. The acceptable business standard for a weekly payroll is no more than 7 days following the end of the pay period. Is there a number in PA you can call to inquire? What about the new foreman? Certainly there is someone in charge locally who can go to bat for you. At least to find out when the checks were mailed. But they send them to the foreman's home? :eek: ouch. Not illegal, by any means, but certainly a poor business practice.
And if you're going to continue working there, definitely sign up for direct deposit.

Here I go again, the checks were mailed from PA 6 days ago, the foreman's child had seizures last night, he cannot be reached, and I am not getting paid...AGAIN!!! The pay week usually ends on Friday, some of us do not recieve checks until the end of the following week. Paydays are on Fridays!!! There has to be someone who can help to straighten this out. This company is a nationally known company, and is in 7 other countries. Definately bad practice.

I agree it's bad practice. But, like I said before, Florida has no laws regarding when paychecks are due employees. You can try contacting the federal Dept. of Labor at 866-4-USADOL.
