I have recenlty quit my job, given two weeks notice. payroll went out on the 18th of April and it's now the 22nd. I have still not received my paycheck in the mail. on top of everything this former employer harassed me during my materinity leave. i took two weeks vacation for the first two weeks and they called me everyday and then he also demoted me 6 days after i had the baby an dthought that i would be back to "normal" one week post partem. I have documented every conversation we have had. ON top of it all, he never offered any maternity leave so i had to work 2 wks pp to make a living. But this other girl in the office is getting paid 100% for 6 weeks of medical leave. he does not offer short term disability. Why is it okay for her to get paid 6 wks and not work and me not able to be offered that?? I have been an employee for 5 yrs, she 2 yrs. I don't think it's fair at all. Is it b/c she had cancer??? I feel discriminated!!!!!!!!!!
We don't know why. We're not inside your employer's head and the LLT crystal ball is out being recalibrated. :)
Had she worked their longer than you? Is she in higher level position than you? Did she negotiate this benefit at hire? Is she under a contract that provides for it?
How do you KNOW what benefit she is receiving? Is it possible that it is only rumor?
With regards to your paycheck, no, your employer cannot hold it but the US mail being what it is, it's a bit early to assume that's what is happening. If you don't get in in Monday's mail, give them a call to let them know. If you don't get any satisfaction with the phone call, get back to us then and we'll try to walk you through it based on what you're told at that time.

i was the office manager there longer than the other girl. i did HR, payroll, etc. i ran the entire office. I got pregnant and eveyrthing changed. my boss stripped me of my title and felt that he paid me too much. we never had an office policy, i made one, but he never enforced it. It's wrong what he did. he made me take my maternity leave sooner than expected b/c i was a nuisance to him. that's how i felt. i was able to work ,i wasn't disabled, but he forced me out. I am the one WHO took care of all the benefitS!!!!!!!!!!!!!!!!! I knew everything, who made what, how much was paid out, what benefits were there, becasue I DID IT ALL!!!!!!!!!!!! She is NOT of higher level or rank than me. I'VE BEEN THERE FOR 5 1/2 YRS, SHE ONLY 2 YRS.
Okay, there's no need to get snippy about it. I only asked. I'm not a mind reader.
If you feel that you have been discriminated against on the basis of your pregnancy, you can contact the EEOC.

Maybe you were a problem employee, and your pregnancy was a good chance for the employer to try and get rid of you??
I dunno, but it sounds like you have a huge ego problem as well. Maybe he feels he got as good a value from the 2 yr office manager, compared to you. I know people dont like to hear it, but sometimes people get too comfortable in a work environment.
Agent, since this post is from April, it's not likely that she's still coming back looking for new answers.
I know you're new; I'm not yelling at you. But generally I ask that people don't respond to threads that have had no new activity for, say, a month, unless they are either the OP coming back with an update, or have a question about the law being discussed.
