I have some questions regarding employment verification and TN laws regarding this exactly:



1. Can someone please tell me what the laws in TN are regarding employment verification?


2. Is it illegal for an employer to give out such information as: why you were terminated, and if you are re-hirable or not?


3. If a past employer releases negative information about your character, what can be done? Because if this is what is causing you to not receive prospective employment - is there something that can be done, and how can it be proved?

1.) The same as they are in all other states; an employer may provide whatever information is true or that they have a valid and supportable reason to believe is true.

2.) No.

3.) It depends on EXACTLY what is said. Negative references are not illegal. Only untrue references are. If the employer is giving information that represents their honest opinion, in most cases that's quite legal.
