My boyfriend quit working for a certain company in louisiana about 3 or so months ago. Well while he was at this company he made $10/hr, his overtime was only payed at a dollar more so $11/hr for overtime instead of time and a half. His boss was audited and caught doing this to all of his employees. He was told he has 45 days to go back 2 years and pay all of the employees the correct overtime rate and send them a check. I took a class on this and I know you can possibly get up to two times what you were suppose to be paid if you sue. Well the question is...does he have to go back and pay all the overtime hours at the time and a half or does he only have to pay what he didn't pay the first go around. So in my boyfriend's case he would have to go back and pay $15/hr or $4/hr?? Help please.

That's for the state DOL to decide.

How do we find out what he was told by them, so we can find out if he sends the correct amount??

Your fiance will be notified by the DOL.

Although I'm not quite sure why you think he's entitled to be paid again what he's already received.

I'm not saying he's entitled to it I was just wanting to know how they did it. This ex-boss has a tendency to not be completely truthful about anything. So we were just wondering how it went.
