I was employed from an Health System in Portland Oregon. I started working in June and found out I was pregnant in July. I informed my supervisor of this. Shortly afterwards I started having complications (pre term labor) and have been absent 5 times (with MD notes/Letter) in 5 months. I was terminated due to my abscenes. My supervisor was aware of my pregnancy complications and the fact I ended up in the OB Ward twice and had one amino test. I was waiting to get to my six months before I requested time off so I could use my PTO and EIT pay. Now that I have been terminated I have NO paid time off, I can not afford to pay for Cobra, and I believe they violated the FMLA? What can I do. I had hoped my supervisor would work with me and put me on light duty but instead she terminated my employment.

Oregon has one of the most comprehensive guaranteed leave statutes in the country. You can get information about the leave at: http://www.boli.state.or.us/technical/taoflaqa.html

After reading the website, let me know if you have any other questions.

I was told that the FMLA did not apply to me because I was in my six month probationary period even though my abscenes were due to problematic pregnancy. What can I do?

Unfortunately, I don't believe that there are any other options for you. Let me know if you have any other questions.
