I am trying to find out what the laws say about sick leave accrual payout upon termination of a job. I was recently laid off and just passed my anniversary date in February. My sick leave balance was just placed in my account for 52 hours as of February. Unfortunately I have no access to the company policies anymore to find out what it states in regards to the sick leave balance when an employee is terminated. One would think that they should pay it out otherwise every employee would always be sick to be sure they used the benefit vs. never receiving a dime. My husbands company pays it out to the employee to promote attendance. Can anyone help with this subject, so I can determine if I should continue to pursue the monies due me? Thank you.

No state requires the payout of sick time at termination (unless it is included in a PTO policy, where all absences for whatever reason comes out of a single time bank). Some states, including yours require the payout of vacation time, but sick time is a conditional benefit, payable only in the event of illness, and is not considered part of your wage packet to be included at termination.
