I gave my 2 week notice at my job last week. Due to being in sales and moving over to a competitor my employer decided to immediately walk me. In the past with other employees they paid for the two weeks, however in my case they are not paying me even though I did give a 2 week notice. Before I make a case about it I was wondering if I am entitled to the pay. Four weeks ago another manager in my department was walked and did receive pay for the 2 weeks.

No, there is no law that requires you be paid out your notice period. The fact that they have done it for other employees does not mean they are required to do it for you.

Do you have any legal references regarding this topic?
Thanks in advance.

Only in a negative sense. You are not going to find a law that says, "An employer does not have to pay out an unworked notice period". The law states what an employer MUST do and what he MUST NOT do. It does not address what the employer MAY do. There is no law that says he MUST pay out unworked notice; there is no law that says he MAY NOT pay out unworked notice. It is the choice of the employer whether to do so or not. Therefore, it is not directly addressed by law.

Just so I am clear... if two employees give their 2-weeks notice and both are let go immediately, and one is paid for their 2 weeks and the other is not, there is no concern for any legitimate discrimination issues being raised, etc.?
Thanks
This would only be an issue of illegal discrimination if there were valid and supportable evidence to suggest that the employee who was not paid, was not paid BECAUSE OF their race, religion, national origin or other characteristic protected by state or Federal law.
