View Full Version : Questions about CA Full-time minimum hours in a week requirements

Hi everyone!

I have worked at (major retail chain) for 6 years. I have always had a full-time designation, and at least 32 hours a week. Recently my store got a new Store manager who does the schedules for my TV department. The TV manager does not do our schedules for some reason. This week the store manager wrecked havoc on my scedule and I have a few questions:

1. What is the minimum hours in a week a CA full-time employee is required to get. I thought it was 32, now I'm hearing 30 from my manager?

2. This week I only received 21 hours. Every other full-time associate in my department got at least 32 hours. My manager told me he cut back my hours to 21 because recently my sales have gone down. (But in March my sales were great!) Can he do this?

3. My manager also told me that if he gives me 22 hours, plus the 8 PTO hours I will use on Easter, then that would equal the 30 full-time hours I need. This sounds ludicrous to me. What if I happen to not have 8 PTO hours accrued? I think I should have 30 or 32 regardless of the week having a holiday, right?

There is no guarantee that you will be scheduled for a certain number of hours. California law does not address the issue of scheduling.

However, since your hours have been decreased, are you losing your eligibility for benefits? That's a related, but different, issue.

CA Unemployment code

1252. (a) An individual is "unemployed" in any week in which he or
she meets any of the following conditions:
(1) Any week during which he or she performs no services and with
respect to which no wages are payable to him or her.
(2) Any week of less than full-time work, if the wages payable to
him or her with respect to the week, when reduced by twenty-five
dollars ($25) or 25 percent of the wages payable, whichever is
greater, do not equal or exceed his or her weekly benefit amount

You may qualify for Unemployment benefits.

Hello,

You can file for Umemployment benefits because you are working less then full time. Watch how fast you get your hours back. You can collect partial benefits.

California EDD considers anything less then 32 hrs per week to be part time work.
