My brother and his wife are try to buy a piece of property in the town of Pecos. The property at one time had an approved easment by three other property owners. During the time the house has been on the market the house went into forclosure. The property has had several accepted offers but never has been able to close because there is one neighbor that will not sign off on the property easement. This easment is the only access into the property. Within the last several days the bank made an offer to my brother at a highly discounted rate, to pay cash for the property and you deal with the access issues.
We are looking for any information to help us make the right decision.

Consult a local attorney or local zoning officials and pursue getting an easement by necessity because it is not about the person refusing, so much as the need for access and if it is not given, be prepared to go thru the process to get the easement. The process varies from county to county, so you need to find out the process for that county to get an easement by necesssity granted that runs with the land and is included in the property description with that property in perpetuity.
