It most certainly is. No law in ANY state requires your employer to provide you with smoke breaks; nothing in either Federal or Montana law requires that you be provided with any breaks at all. Meal breaks, rest breaks, smoke breaks, and any other kind of breaks are entirely at the option of the employer. This remains true regardless of whether you are full time or part time.
