We are currently being taken to small claims court for damages to our former apartment. We were wondering if a written statement made by a party unable to attend would hold up in court. The party is a witness, not actually part of the civil suit. Any input would be great. Thank you.

Written statement should be an Affidavit and should be notarized and given under penalty of perjury to be admissible before the court. Consult a local attorney for more advice on if more would be needed for the written statement to hold up in court.
