I have searched this site several times looking for an answer but I cannot seem to find it so here goes. My fiancee and her daughter live with me. Her daughter's father is leaving this week on vacation for a week but could not take his daughter because it is over Easter Weekend and the custody order clearly states that vacation schedules override any and all other schedules in the order. The question is this. He is stating that on his visitation days that his daughter must go with her grandmother since they are his days even though he is not going to be around (he will actually be 1000 miles away in FL). I was told that if a parent leaves on vacation, business, etc without the child the the other parent has the first option in keeping the child while the parent is away. To give you some more details, my fiancee has primary custody of the child. She goes with her father every tues /thurs on week one and tues, fri-sun on week two. Thanks, Scott

grandmother is not in the visitation schedule, is she. then the she is to stay with mother while father is away. if the mother doesnt object then the child can go with grandmother, but she is not obligated

It's really not a matter of "can dad give is visitaion to grandma?". Visitation is non transferable. However, if dad actually picked the child up for the regular visitation and HE dropped the child off with grandma, it is pefectly acceptable. He can chose to leave the child with anyone he choses during HIS time, but he cannot force mom to give the child to grandma.
