:mad: Well I was working for a office that the office manager went behind my back and decided on her owen to get me results from a hospital and they gave her the results. And then proceeded to tell other employee's what she did. I can no longer work there for I felt really violated and well I could not trust them. I did not go to the Admin because that is the office manager's husband. I need some advise.. please help :mad:

Sounds like it could be. Have you signed anything allowing it? I have worked for an employer who had the release mixed in with other paperwork , I assume they thought nobody woul read it.

The employer would need to present a release to the hospital signed and authorized by you to access any medical records. Is this for workers comp?

Ask the hospital medical records department why your confidential information was released.

If the facts are as you present them, the employer did not violate HIPAA; the hospital did. ASKING for the information did not violate HIPAA; but unless you had given the hospital a written release authorizing your employer to receive the information, GIVING the information did.

In addition, the only information HIPAA requires an employer to keep confidential, is information they obtained through your employer-sponsored group insurance policy. So giving the information to other employees, while unprofessional, did not violate HIPAA.

So CBG,

I was discussing my domestic partnership enrollment process with my HR Director. We were discussing what documents specifically I needed to provide so that my DP would have benefits. It was a lengthy and complicated situation.

A few hours after our discussion, she went and discussed the situation with my manager. My manager came up to me and attempted to discuss the situation with me. I told her that it was none of her business.

Did my HR Director violate my HIPAA rights?

No, she did not. Information that you provide is not protected under HIPAA.
