Hi all,

I have a friend that is in a bit of a pickle. Last Tuesday she submitted her two weeks notice; last day effective 04/18. After she submitted her letter of resignation, her manager told her she will not be working out the final two weeks and collected her laptop and related items the next day. On Friday she received a call from her manager stating that she will only be paid for 5 days of the two weeks. Is this legal? How can an employee give two weeks notice, be walked from the position, and not collect pay for the full two weeks knowing that she would have worked those final days? She was a salaried employee, not sure if exempt or not. What are the qualifications for an exempt employee? Thanks for any help.

There is no law in any state that requires payment of notice pay. Some employers may choose to pay it out, but they aren't required to. It's irrelevant the exempt/nonexempt status of the employee.
