"Your skinny little butt, won't mind the exercise", Obese female supervisor said to male subordinate. Is it harrasment?

It IS harassment. But contrary to popular opinion, not all forms of harassment are prohibited by law. Yes, it is harassment, but it may or may not be illegal. The question is, WAS IT SAID IN A SEXUAL MANNER? Did she mean that if he exercised his rear end in the bedroom that he would plump up, or did she just mean to work out the gluteus maximus?

A lot of companies have adopted a "zero tolerance" policy toward any type of harassment whether it is illegal or not. Sexual harassment is "unwanted" so the supervisor would need to know that it is unwanted.(if it was a sexual remark) the word "stop" has a LOT of power when it comes to sexual harassment. If stop doesn't work then one would need to escalate to the higher level.

Sexual harassment is unwelcome conduct of a sexual nature. I don't see anything sexual in that statement. Usually one comment such as that one, even if sexual, isn't illegal harassment because it isn't egregious and hasn't occurred frequently enough to alter working conditions. Harassment, by defintion, involves repeated actions. The American HeritageŽ Dictionary defines it as follows: to irritate or torment persistently.

Regardless of whether you define it as harassment or not, a single comment is not enough to support a claim of illegal harassment or hostile work environment.
