View Full Version : 2 Day Pay Or Quit rule/law??

My question in general is where can I find individual state guides on this subject? I live in Spokane, WA...I was issued a 3 day pay or quit notice...my understanding is that after 3 days they can forcefully evict me from my residence? WHat is the procedure?

I found the info on ...Accessevictions.com

If the lanlord is trying to get you out (evict) then they probably will not accept partial payments...because if they did, it would start the entire process all over again with having to serve you with another 3 day notice.

But they are not allowed to serve you the 3 day pay or quit until you are late on your rent..even if you tell them you won't have next month's rent by due date or at all, they can't serve you the notice until after the due date. and they have not recieved payment..otherwise they can find themselves in alot of trouble.

Also they are only serving you to collect the rent only and not utilities.

my main concern is the extremely short time given to basically "get out" if I can't come up with my rent. My husband is out of state, I have NO family here. Boo hoo I know but anyhow, this is what I'm trying to learn so I can go about getting prepared to either start packing my things or if I have a couple of weeks to get my rent caught up

Well from what i read on the matter...it seems like you need to start packing...unless you can come to some type of agreement with your landlord regarding payment on late rent being paid in installments or within a certain amount of time which allows you to stay in your apt.
Remember if landlord does agree to allow you to stay in apt while making payments...i would have them to give me that in writing...so they can't just toss me out on the street or at least if they do you can show judge in court that the landlord did not honor your agreement....which can work for you and not against you.
But you need to talk to landlord fast, because once they file paperwork at the courthouse...any chance of negotiating with them is pretty much a done deal...unless they want to be nice, but then again if they do they will make you still pay for court filing fees and any attorney fees along with rent that is in default etc....good luck

This sounds like notice to pay or you will be subject to eviction. If you cannot pay, then I suggest if you can to vacate and leave. However, even if you do this, you need to have pictures and make sure that you are not charges damages you do not owe and document your leaving. The problem is you are liable for damages and rent until the unit is re-rented, so they will likely still pursue damages, less the deposit paid.
