View Full Version : Maintenance worker entered apt unannounced and i was naked - tx

I called for a maintenance request a week ago and the senior maintenance worker entered my apartment today, 4-7-06, with his key without knocking or any type of notice. I had got out the shower and I was was completely naked. I feel so violated. I sreamed at him to leave and called the manager immediately. The manager apologized and said she will talk to him. The maintenance guy came to my apartment and apologized from outside because I didnt open the door. Any suggestions? Can I break my lease or sue for civil damages? I can't even look at this guy. PLLLLLLLLLLLLLLEASE HELP.

Look at your rental lease and see if there is a clause in it about gaining entry into your apt dwelling and if so, do they have to give notice...i know in most places, they give a notice, however i do know in emergencies notice is not required.
But look up the ...Uniform Residential Landlord & Tenant Act...which has laws that are universal for all states, but you still need to look up your individual state landlord/tenant laws.
You need to make a letter and give it to your landlord about the action that took place at your apt, with the date and if you can get the name of the maintenance worker as well, so they can have it on file at the office, and make sure you take note as to whom you delivered the letter to, because they are good for losing paperwork or denying recieving anything. KEEP a copy for yourself also (you can send it certified mail to landlord).
You have a right to privacy in your rental unit ...and I must agree he did cross the line entering your apt without knocking.
I've been in the same situation in a tee shirt and they knocked once and let themself in with a key before i could get to the door...needless to say my husband was angry and went off on them. As a matter of fact they did it to me about 2 weeks ago and i kept my cool since i was dressed and up walking around but it infuriates me how they don't wait for a response to the knock and or just don't bother knocking and come on in.

In the Uniform Landlord Tenant Act (section 4.302)- ABUSE OF ACCESS..if the landlord makes unlawful entry or a lawful entry in a unreasonable manner or makes repeated demands for entry otherwise lawful but which has the effect of unreasonably harassing the tenant, the tenant may obtain INJUNCTIVE RELIEF to PREVENT the recurrence of the conduct or terminate the rental agreement. The tenant may recover actual damages (not less than an amount equal to 1 month's rent and reasonable attorney fees. :D

It could be that the worker knocked and there was no answer because you did not hear the knock in the shower and the worker came in thinking it was ok; I understand how you feel because a maintenance worker once locked me out of my place and I was in a shower towel and had to go get let in. But this sounds like an accident brought on by inability to communicate. Suggest that in the future maintenance appointments be made in advance with you prior to entering your unit, unless it is an emergency situation.
