Some states have began to address the issue of using computer equipment for stalking, by including provisions prohibiting such activity in both harassment and anti-stalking legislation. Check your state anti-stalking statute's. She need's to send a email to person stalking her requesting for them to cease any further communication to her and that the stalker's advances are clearly not wanted, she should only do this once and no matter the response do not communicate to stalker again. Also your sister need's to make and save copy of communication in electronic and or hard copy. File a complaint with the stalker's internet service provider (ISP). As well as notifying your own (ISP). Some (ISP) offer tools to block unwanted communication from specific individual's. Record dates and time's of all contact with stalker, save any and all email's postings, email heading's etc. Your sister may also want to keep a journal of how each episode has made her feel, and what if any response was given to stalker, or any threats made by stalker. File a report with your local police enforcment agency or your local prosecutor's office, to see what charges can be pursued, and keep copies of any police report's filed and the names of the officers you have spoken to on the matter. You may want to change your (ISP) email address, home phone number or invest in good encryption software. Also make sure that your name and phone number are not listed in public online directory or phone books and if they are then have them removed ASAP. Dawn-IL 04-07-2006, 06:31 PM I don't know what state you are in but in Illinois the law is very clear. violation of following Illinois Statutes: (720 ILCS 5/16D 5) (from Ch. 38, par. 16D 5) "...(1) Accesses or causes to be accessed a computer or any part thereof, or a program or data, for the purpose of devising or executing any scheme, artifice to defraud, or as part of a deception;" (720 ILCS 5/16G-10) "...User names, passwords, and any other word, number, character or combination of the same usable in whole or part to access information relating to a specific individual, or to the actions taken, communications made or received, or other activities or transactions of a specific individual..." (720 ILCS 5/16G-15) "...uses any personal identification information or personal identification document of another to portray himself or herself as that person, or otherwise, for the purpose of gaining access to any personal identification information or personal identification document of that person, without the prior express permission of that person, or (7) uses any personal identification information or personal identification document of another for the purpose of gaining access to any record of the actions taken, communications made or received, or other activities or transactions of that person, without the prior express permission of that person..." ceara 04-07-2006, 09:30 PM Can anyone tell me indepth about cyber stalking? Ceara, she is not sure of the identity, but everytime after she chats online with friends, some of them ( her friends) receives messages addressed in her name saying things like, " meet me a such a place in two hours, don't call me just be there". Really, i didnt know it was possible to do that !! Or she might have arranged a meeting with a friend, and when she gets there.. like at a restaurant, someone sends a note of hello baby. We think that it comes from the net. That is very creepy. Since he seems to at least be in the general area, start with the local PD. Have your sister save EVERYTHING sent from him and give a COPY to the police as she receives them. It may take a few trips to the PD before they actually DO anything, but once they see the pattern, they would HAVE to take action. |
