I have been with employer (ex as of today) for almost 2.5 years. When I started I signed all paperwork including a background check. During my employment I ended up in a mess with others and I couldn't afford an attorney. This went on for a while and I was fighting the charges. Long story short I had a bad pregnancy (very sick) and ended up doing what the attorney advised; which meant a felony on my record (I am fighting this now - or trying to ... appeal). Regardless there was bad blood between my boss and I while I was signed out on my pregnancy and working from home. After my mat leave the day I came back I was written up (having been out of the office for 3 months on mat leave and working for home the prior 6 months) regardless he put me on a 30 day notice of no sick time etc not even for my child or face termination.
Then he asked me who someone was? I had no idea who that someone was (found out it was someone calling to verify my employment in regards to the felony which was the Parole Officer I had never met) That person called 3 times and I had never heard the name.
My boss travels a lot and my son is very ill with an illness. My 30 days was up 2 weeks ago and this week I've been out with him due to his health.
I was asked to join a conference call this morning with him and our HR rep. I was terminated for having a record.
They said they went through my employment information and couldn't find my initial background check screening (they did one trust me) and since they still had my ok to do one they ran this and it came back with this information and it was grounds for termination automatically, however they were going to send me information for me on my benefits and how I can pay to keep them and they were going to pay me for next week as well (just to be the nice people that they are).
I'm confused - can they run a new background check on me? I didn't 'lie' on my application b/c this was not there at the time it happened while employed. Or were they looking for a way to get me out and this presented itself to them in a nice little package with a bow and if so, am I allowed to file for unemployment in NC.
They still owe me for a past trip and for all my phone calls from working from home which I've asked for reimbursement going back over 5 months.
Help ... hope this makes sense!

Sorry, but I don't have a clue what you've been talking about. It's Friday night and it's been a really, really, REALLY long week with a lot of upsets and I've been sick most of the week on top of it, so it might be me, but would you mind awfully trying again? :confused: :)

yes they do have to pay you for what time you have worked.---as far as your termination goes--the bad blood you spoke about between you and your boss is more than likely the reason for the sudden back ground check---the fact that you had agreed to one before employment is irrevelent--do you remember if keeping a clean record through out your employment there was or is requirement----my opinion is this----because of the bad blood between you and your boss they would have gotten rid of you any way--probably saying you missed more days than allowed by the company or the fmla act---the fact that you got in trouble and the background check was ran--that was more convient for them and easier to make stick.
