We own a piece of property in West Virginia, which has a part of the road that is on another person. This road has been there since my in-laws purchased the property in 1968. The road goes to a hunting cabin. There is access to this cabin from another direction, but the road is very steep and treacherous. The owner of the property is going to timber the property and contacted a lawyer to tell us to stop using the road. The road is right on the edge of this other owners property. Since this road has been in existence since before 1968 do we have any rights to it?

Consult a local real estate attorney or research adverse possession laws on your own and file an action to quiet title to the road and an easement for the road based on adverse possession grounds. I suggest doing this asap because I suspect that is where the neighbors are headed, and if you do not contest their claim asap, it could get ugly.
