I have a new granddaughter. My daughter had this precious bundle with a man who was separated from his wife. Since then the couple reunited. The baby is on the father's medical insurance now. The court date for child support will be coming up in May. I am worried about how payments will work if the father is in another state. He is moving to Florida. We are in NY. I am concerned that the laws in Florida may not be enforced as strictly as in NY. I would hate to see this "man" get away without paying child support. Is there anything my daughter should be aware of when she goes for the child support hearing?

If the father moves out of state it will be a Interstate Child Support Case. He will still be obligated to pay his child support. You can read about Child Support in NY by visiting these sites. NY has jurisdiction. Did he live and work in NY?

I am so happy to hear that the father will have abide by the child support order. I had heard thru the grapevine that if he moved to Florida that the order would not be enforced. This just didn't make sense to me, since it would be a court order, I would logically think that it would follow him from state to state. I had to ask. Thank you for easing my mind on that count. I really hope that when they issue the child support amount, it will take ALOT of burden off my daughter. It is hard enough for a first time single mother to completely change her life so she can give her little angel the care she needs without having to worry about all the money issues attached.

The father at present lives and works in New York City, so he has good medical coverage and makes a decent salary. He will be moving to Florida but no date has been given when this will take place yet.

No matter where he moves, the support order will be in effect. Is he being garnished or is he sending the payments directly? If he's not being garnished have your daughter request that they garnish him. This way CSE can track his payments. Where ever he works, there will be an income execution sent to his job to have the payments deducted and sent to your daughter.
If he decides to take a lower paying position, he might still be held at the rate he was making in NY depending on the circumstances and the judge. NY judges are very hard on ncps. I think it's one of the tougher states.
Does your daughter have a lawyer, or is she representing herself?

I will have to tell her to request that the CS payments be garnished from his salary. I know that the hearing is in May but I don't think she hired an attorney. He makes a good salary in NY so I hope the order will reflect that and not the Florida State salary. I am not sure if the rate changes from state to state since he is in law enforcement. (that is a laugh huh?... law enforcement) He really should knnow better.
