So, are judges known to give the tax exemption to the NCP every other year? It does seem only fair but when my husband divorced his ex, he told her he wanted that and she said that her lawyer said she didn't have to. We didn't take it any further, but we'd like to have it modified if there's a possibility.

My personal case is set that way and i claim my child every other year. If there is a current support order and it does not specify the rules of exemption, then who ever files first as far as the Irs is concerned. But he should talk to his or an attorney

If it is not spelled out in the custody orders or divorce decree, then the parent that the child lives with at least 50% of the year and contributes at least 50% of financial support is entitled to the tax credits. If joint custody, or time and finances are split evenly, it is fair to alternate years to claim the child.
