I am An Exempt (Mgt) employee in CA. I have a significant sick leave balance. I think others in my title have been given PTO benefits. I resigned and will be leaving behind 5 months of sick leave. Do I have any rights since others were given the PTO benefit??

Do you not have PTO? Do you have vacation and sick separately instead? Do the other employees have sick also, or just PTO?

I have sick and vacation. I do not have PTO. I think others in my job title have been given PTO, and I was not given the opportunity to convert to PTO

The only requirement is that you be paid out for vacation, not sick. I am curious though, WHY you were not converted to PTO? Were there other employees who were not converted also? Companies usually convert everybody when they implement such a change.

That is one of my issues. I believe others in my job class/title were offered PTO.. or somehow grandfathered into PTO and this was never offered to me.
Some VP's came to our Co. via corp acquisition, so that would explain the grandfather clause. I would think it would be offered to all.

I'm curious why the poster thinks that other employees were converted to PTO.

Doesn't sound like there's any certainty that it actually is the case.

To respond to the moderator - I know some of my subordinates/direct reports were on PTO - I was their supervisor.

I have asked the HR VP (in writing) if any employees with my title and job class were in a PTO plan. They have failed to answer and say that they may need to get legal's approval and that the information may be proprietary.

They can't offer everyone else a deal and not you?! Unless the people possibly have been there longer and have a grandfathered deal...
That's why they won't give you anything stating that in writing, I would go to the labor board and talk with them about this, take the company policy and take information about others who have the better plan than you.
