I live in TN and in August of last year I gave my brother (who lives in Maine) guardianship of my 15 year old son because I was having problems with him and was ready to send him to juvenile detention. My brother wanted him to come live with him and he wanted to try to help my son. My brother has tried to help him and has not been successful and may need to sign custody back over to me. My question is how do I go about filing for custody of my son? My brother handled all the legal stuff when he took guardianship so I don't have a clue what he did, and he is in Maine so the laws and procedures are most likely different for Tennessee. Does anyone know how I get this process going without a lawyer? I know my brother did his paperwork without a lawyer. There is no dispute involved so I would think it would be a fairly simple process. Any help would be greatly appreciated.

Have you and your brother jointly file a petition to have the guardianship rescinded or dissolved. You can put this together yourselves, but I suggest going thru an attorney to at least prepare the petition.
