I'm in Texas and I am basically just looking for answers right now, so if anyone could help me, that'd be awesome.
Well, my father was supposed to pay child support for me and my two brothers, but he never did throughout our entire lives. The court told him he was supposed to, but that didn't mean anything to him. He has no job and hasn't in years, so I am looking for back pay to help me pay for college and other expenses, is there anything I could lawfully do even though he has no job? I mean, this is really important to me. My mom is a single mother of three and never had help from him once, so it'd be nice to get something out of this. YOU are not entiled to ANY money from dad. Your MOTHER is the one that is owed child support, so it would be up to her to try and collect. CS arrears are viewed as money that has already been spent. So if mom does get anything, she is under no obligation to spend it on you or your siblings.

Besides, if he has no job and no money, how do you think he is going to pay the support? You can't take something that's not there.

Ceara is right. The child support is owed to your mother. She is the one who paid for raising you, your father was supposed to help with that support. Since she spent her own money raising you, any back child support is owed to her for reimbursement for all those years.

Okay, my mom was going to use the money to help get me through college....
The reason I was ASKING, is because I was curious if he could get sent to jail and the state pay money while he's there. I didn't know, that's how come I was seeking some answers. :confused:

This is something you're mother will have to handle. I can tell you, though, that even if he is sent to jail (unlikely unless there is already a warrant for his arrest) the state will NOT pay the money. Why should the state pay? The state didn't raise you. I know what you were thinking, but it doesn't work that way. If he was sent to jail he would have to pay a purge to get out.
